These Terms and Conditions set out the basis on which Waste Clearance Streatham provides waste clearance and related services to residential and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means any individual, business, organisation or other party who requests or uses our services.

Services means any waste clearance, waste collection, rubbish removal, loading, transportation, sorting, or related services provided by Waste Clearance Streatham.

Waste means any items, materials, junk, rubbish, refuse or goods presented for collection and disposal as part of the Services.

Contract means the agreement between Waste Clearance Streatham and the Customer for the provision of Services in accordance with these Terms and Conditions.

2. Scope of Services

Waste Clearance Streatham provides waste collection and clearance services across the local area, including removal of general household waste, garden waste, non-hazardous commercial waste, bulky items, and light construction debris where agreed in advance.

The exact scope of Services for each booking, including the nature of the Waste, estimated volume, loading requirements, access arrangements and charges, will be confirmed during the booking process. Any services not expressly agreed will fall outside the Contract.

We reserve the right to refuse the collection of any Waste that we reasonably believe to be hazardous, prohibited, unsafe to handle or transport, or which exceeds the agreed volume or weight limitations.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online enquiry or booking channels where available. A booking is only confirmed when we have accepted your request and provided a booking confirmation with the proposed date, time window and estimated charges.

3.2 The Customer must provide accurate and complete information at the time of booking, including the type and approximate volume of Waste, the collection address, access details, parking restrictions, and any special handling requirements.

3.3 Our quotations are usually based on estimated waste volume or load size and on the information you provide. If, on arrival, the actual Waste is materially different from the description provided, or if access is more difficult than described, we may revise the price, adjust the scope of the work, or decline to carry out the Service in whole or in part.

3.4 Time slots for attendance are given in good faith but are estimates only. While we aim to arrive within the agreed time window, factors such as traffic, previous jobs and operational issues may cause delays. We will make reasonable efforts to keep you informed of significant delays, but time is not of the essence in respect of our arrival or completion times.

4. Customer Obligations

4.1 The Customer is responsible for ensuring that:

The collection location is safe, accessible and suitable for our team and vehicles.

Any necessary permissions for parking, site access, building entry or use of service lifts have been obtained in advance.

Waste presented for collection is as described during booking, is not hazardous or prohibited, and is reasonably segregated where requested.

4.2 The Customer must ensure that an authorised person is present at the property at the agreed time to grant access, confirm the items to be removed, and approve any variations to the Service or charges before work begins.

4.3 If our team considers that access to the property is unsafe, obstructed or significantly different from what was described, we may refuse to proceed until the situation is rectified. Any waiting time, additional labour or abortive visits arising from such issues may be chargeable.

5. Waste Types and Prohibited Items

5.1 Waste Clearance Streatham will not collect or transport hazardous or specialist waste unless explicitly agreed in writing in advance and subject to additional charges and regulatory requirements.

5.2 Prohibited items typically include, but are not limited to, asbestos, medical or clinical waste, chemicals, solvents, oils, fuel, gas bottles, pressurised containers, explosives, flammable liquids, radioactive materials, unidentified chemical containers, and any waste for which we are not appropriately licensed or insured.

5.3 If prohibited or hazardous items are discovered among the Waste without prior disclosure, we may refuse to collect them, and we may either leave them on-site or return them if already loaded. The Customer will be responsible for any additional costs or losses we incur as a result, including safe handling, segregation or disposal costs.

6. Pricing and Quotations

6.1 Charges for our Services are usually based on a combination of waste volume or load size, weight, labour time, access conditions and disposal costs. We may also charge for additional services such as dismantling, extra labour, or specialist handling.

6.2 Any quotation provided before inspection is an estimate only, based on the information supplied by the Customer. The final price will be confirmed on-site once our team has assessed the Waste and the working conditions. Where possible we will agree any change in price before commencing work.

6.3 If you do not agree to a revised price proposed on-site, you may decline to proceed. However, we may charge a call-out or attendance fee to cover our time and costs where applicable and notified in advance.

6.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any changes in disposal charges or regulatory costs may be reflected in our pricing from time to time.

7. Payments and Invoicing

7.1 Unless otherwise agreed in writing, payment is due in full on completion of the Service on the day of collection. We accept a range of payment methods, which may include cash, card payments or bank transfer, subject to availability.

7.2 For business customers or account holders, we may agree alternative payment terms, such as payment on invoice within a specified period. Such terms will be confirmed in writing and may be subject to credit checks and account conditions.

7.3 If payment is not received by the due date, we reserve the right to charge interest on the outstanding amount at the statutory rate permitted under UK law, as well as reasonable costs of debt recovery where incurred.

7.4 Title to any Waste passes to Waste Clearance Streatham only once it has been loaded onto our vehicle, and we have accepted it for disposal. This is without prejudice to our right to be paid for the Services rendered.

8. Cancellations and Amendments

8.1 The Customer may cancel or change a booking by contacting us as soon as possible. For standard bookings, cancellations made at least 24 hours before the agreed arrival time will usually be accepted without charge.

8.2 If you cancel or significantly amend a booking with less than 24 hours notice, we reserve the right to apply a cancellation fee to cover scheduling, staff and administrative costs.

8.3 If our team attends the property at the agreed time and is unable to carry out the Service due to issues within the Customer's control, including lack of access, absence of an authorised person, unsafe conditions or refusal to accept revised charges within a reasonable range, this may be treated as a late cancellation. An abortive visit or call-out fee may then be charged.

8.4 We may cancel or reschedule a booking in the event of operational issues, vehicle breakdowns, staff illness, extreme weather or other circumstances beyond our reasonable control. In such cases, we will aim to offer a new appointment as soon as reasonably practical, but we will not be liable for any indirect losses or consequential costs arising from such changes.

9. Conduct on Site

9.1 Our staff will carry out the Services with reasonable care and skill, and will take appropriate steps to minimise disturbance to your property while performing loading and removal tasks.

9.2 The Customer must ensure that the work area is clear of personal items, fragile objects and valuables before the team begins. We will not be responsible for damage to items that should reasonably have been moved or protected by the Customer in advance.

9.3 The Customer must not request that our staff undertake any task that falls outside the agreed scope of work, is unsafe, or would breach health and safety standards. Our team has the right to refuse any such request.

10. Liability and Limitations

10.1 Waste Clearance Streatham will exercise reasonable care when working on your premises. If we cause direct physical damage to your property due to our negligence, we will, at our option, repair the damage or compensate you for the reasonable cost of repair, subject to the limitations set out in this clause.

10.2 Our total liability for any loss or damage arising under or in connection with the Contract, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.3 We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, loss of data, or any costs incurred as a result of delays, rescheduling, or cancellations, except to the extent that such exclusion is not permitted by law.

10.4 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot legally be excluded or limited.

11. Customer Property and Valuables

11.1 It is the Customer's responsibility to ensure that no items of value or items not intended for disposal are left within or among the Waste. Once loaded onto our vehicle, Waste is unlikely to be retrievable.

11.2 We accept no liability for items that are removed and disposed of as Waste where the Customer has failed to clearly separate or identify items that should not be taken.

12. Compliance with Waste Regulations

12.1 Waste Clearance Streatham will handle, transport and dispose of Waste in accordance with applicable UK waste management legislation and regulations, including duty of care requirements and licensing conditions relevant to the type of Waste collected.

12.2 We may use authorised third party disposal facilities, transfer stations or recycling centres. By using our Services, you authorise us to choose appropriate disposal or recycling routes, provided they comply with legal and environmental obligations.

12.3 Where required, we will complete waste transfer notes or similar documentation. The Customer agrees to provide any information reasonably necessary to complete such records accurately, including the nature and origin of the Waste.

13. Data Protection and Privacy

13.1 We will collect and process personal data such as contact details and address information for the purposes of managing bookings, delivering Services, invoicing and handling queries or complaints.

13.2 We will take reasonable steps to keep your personal data secure and will not sell or disclose it to third parties except where necessary to provide the Service, comply with law, or support our business operations, such as using payment processors or waste disposal partners.

14. Complaints and Dispute Resolution

14.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing full details of your concern. We will investigate and aim to resolve complaints promptly and fairly.

14.2 Where a dispute cannot be resolved informally, either party may pursue its rights through the courts as provided by these Terms and Conditions. Nothing in this clause affects your statutory rights as a consumer, where applicable.

15. Variations to These Terms

15.1 We may amend or update these Terms and Conditions from time to time to reflect changes in law, best practice or our operational processes. The version in force at the time of your booking will apply to the Contract for that Service.

15.2 Any variations to these Terms and Conditions requested by the Customer must be agreed in writing by an authorised representative of Waste Clearance Streatham to be valid.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed not to form part of the Contract, and the other provisions shall not be affected.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any Contract between Waste Clearance Streatham and the Customer, are governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation.

By making a booking or using our waste collection and clearance services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
